Terms and Conditions for use of BirdSpot
1. Introduction
These terms and conditions ("Terms") govern your access to and use of the mobile application BirdSpot, which is owned and operated by Aves Development ("we", "us", "our"). By using BirdSpot, you accept these terms. If you do not accept the terms, you may not use the app.
2. Purpose of the app
BirdSpot is an app designed for sharing and documenting bird observations. Users can upload images, descriptions and locations of bird observations. Users can also engage with "Flokks", a group feature and online community where discussions and knowledge sharing can take place between BirdSpot users.
The app may only be used for purposes related to bird observation and sharing. Uploading other content, including images and information that do not relate to birds, is not permitted.
We reserve the right to remove content and/or delete user accounts without notice if the app is used in violation of these terms.
3. User behavior
By using BirdSpot, you agree to:
- Comply with applicable laws and regulations.
- Not upload offensive, insulting, false or irrelevant content.
- Respect other users' rights and experience.
- Use the app for its intended purpose: sharing bird observations and the Flokk community.
4. User license
When you upload content to BirdSpot, you grant Aves Development a non-exclusive, worldwide license to display, distribute and use this content in connection with the app's functionality and marketing.
You retain all rights to the content you own.
5. Subscription and payment
BirdSpot offers both BirdSpot Light (free version) and BirdSpot Pro (paid version), which can be accessed via a subscription-based payment system.
BirdSpot Pro:
- Offered as monthly or annual payment.
- Provides access to additional features not available in BirdSpot Light.
- Payment is handled through Google Play Store and Apple App Store, and is subject to the respective stores' terms.
Renewal and cancellation:
- Subscriptions are automatically renewed unless cancelled at least 24 hours before expiry.
- Cancellation and management of subscriptions is done via the user's App Store or Google Play settings.
- As a general rule, no refunds are given for ongoing subscription periods.
6. Disclaimer
BirdSpot is provided "as is" without any form of warranty - neither express nor implied - including for functionality, availability, or fitness for a particular purpose.
We assume no responsibility for data loss, downtime or other damage arising from use of the app.
7. Changes
We reserve the right to change these terms and conditions on an ongoing basis. Any significant changes will be announced in the app. Continued use after a change is considered acceptance of the updated terms.
