Privacy Policy for BirdSpot

This privacy policy describes how Aves Development, CVR no. 45763196, email: support@birdspot.eu ("we", "us" or "our") as data controller collects, uses and protects your personal information in connection with the use of the mobile application BirdSpot ("the app").
1. User profile - creation and administration
When creating a user/profile in BirdSpot, we process the following:
Name Email address
This information is a central part of being able to deliver the service, and for user administration. The legal basis for processing is Article 6, paragraph 1, letter b (contract necessity) in GDPR. Your data is deleted when you delete the profile. We store all data about users and profiles indefinitely, provided these are not deleted.
When creating a new user account in the BirdSpot app, you simultaneously accept the activation of a 30-day trial period of BirdSpot Pro. This trial period is free of charge and without obligation. After the trial period expires, and if the user has not actively chosen to continue with a BirdSpot Pro subscription, the user will automatically be converted to a BirdSpot Light user with limited functionality in accordance with https://birdspot.eu/en/terms section 5) and the overview of BirdSpot Pro and BirdSpot Light on https://birdspot.eu/.
2. Creating an observation
When creating an observation in the app, we process and use the following data and information:
• Access to images and audio files on your device (only with permission) = Access to the device's images and audio files is necessary to be able to share these in an observation, if you wish. Specific access to the device must be given, which you will receive a message about. Permissions and the function for this can also be given in the app under "Profile Settings". Images and audio files are used to identify bird species and as documentation for an observation.
• Device information (e.g. model, operating system) = Device information is necessary to be able to deliver the service. This information is also used by BirdSpot, in case of technical errors, to analyze the use of the app, improve features and user experience, as well as optimize the app's performance.
• Geographic location (GPS) = When creating an observation, we use geographic location data (the device's GPS). The location will be based on the device's geographic location, but is chosen by the user to specify where a given bird is located. This means that BirdSpot and/or the app does not track the user's geographic location, but creates a location suggestion, at the moment an observation is created by the user themselves. When using driving directions and other services related to digital maps, we refer to https://www.google.com/help/terms_maps/ and https://www.apple.com/legal/internet-services/maps/terms-en.html, as well as other map services' specific terms that the user may use.
Observations work in different ways, based on the specified conditions cf. point 5) for subscription and payment in "Terms and Conditions". This information is a central part of being able to deliver the service. The legal basis for processing is Article 6, paragraph 1, letter b (contract necessity) in GDPR. Processing of device information to improve the app is done on the basis of Article 6, paragraph 1, letter f (balancing of interests rule), as the information is general and of a non-intrusive nature, and because it is our legitimate interest to improve the app.
BirdSpot reserves the right to retain data about observations in anonymized form, even if a user and their data is deleted. The anonymization is carried out on the basis of Article 6, paragraph 1, letter f (balancing of interests rule), as the data is converted to anonymous data, and because it is our legitimate interest to improve the app. Observation data (and other interactions in the app) will then not be able to be attributed to the individual user, if they have deleted their profile. We store all data about observations, indefinitely, but in anonymized form, if the user (who is the author of observations, comments, etc.) has deleted their profile.
Observations in the app contain various free text fields including; Note field and comment tracks. These fields are filled in by BirdSpot users, and it is strongly advised not to enter personal information herein. BirdSpot is not responsible for any information provided by the user in question, or other users. We refer to 3) in "Terms and Conditions".
3. Creating filters
When a filter is created in the app, we use digital map services that are associated and installed on the device. We refer to https://www.google.com/help/terms_maps/ and https://www.apple.com/legal/internet-services/maps/terms-en.html, as well as other map services' specific terms that the user may use. Filters can only be used if the conditions are met cf. point 5) for subscription and payment in "Terms and Conditions".
The filter consists of predefined regions based on location data, but also the possibility of individual location-based filters developed by the user themselves. The filters can be specific to the individual user, in the case that the user has made individual filters themselves. Location-based filters are accompanied by data for bird rarity, where the combination can be unique to the individual user. The filters constitute a vital part of being able to deliver the service and are thus processed in accordance with Article 6, paragraph 1, letter b (contract necessity). This data will be deleted if the profile is deleted.
4. Creating lists
The creation of lists can only be used if the conditions are met cf. point 5) for subscription and payment in "Terms and Conditions". All created users have a predefined list called "The Denmark List". "The Denmark List" is by default marked as "Not visible to all" and thus private. This can be changed under "Profile Settings". If "The Denmark List" is made "Visible to all" and thus public, it will appear under "Discover" and the list can be attributed to the user. This data will be deleted if the profile is deleted.
Lists can be shared with other BirdSpot users, and you can therefore search for other users in the search field specified for this purpose. This also means that other users can likewise search for your user profile. If your profile is deleted, you will be removed as co-owner of a list, if this is the case. Lists can be both public and private. If you create a list that is public/visible to all, it will be visible on your profile under "Public Lists", and thus can be seen by other BirdSpot users. Lists are also processed in accordance with Article 6, paragraph 1, letter b (contract necessity). This data will be deleted if the profile is deleted.
5. Flokks (Group Feature)
BirdSpot offers the Flokks feature, which allows users to participate in groups based on geographic areas or areas of interest. In Flokks, users can share content, including posts, comments, images, and observations, and interact with other users.
Use of Flokks is subject to these terms as well as any additional guidelines set by BirdSpot.
Content shared in Flokks, including posts, comments, and images, is considered user content and is subject to the same rights and licences as other content on BirdSpot.
Content in Flokks is user-generated, and BirdSpot accepts no responsibility for this content.
BirdSpot reserves the right to:
• Monitor activity in Flokks • Remove content that violates these terms • Suspend or exclude users from Flokks or the platform
6. Third parties and data sharing
We use third-party services for analytical purposes, including:
• Google Analytics for Firebase • Data storage: Supabase.
According to current practice, it constitutes a risk to transfer personal data to the USA. This risk is met by Google being certified under the Data Privacy Framework. Supabase is not certified under this, but we assess that the risk associated with the transfer is sufficiently low because the data subjects are ensured a level of protection substantially equivalent to the EU, cf. https://supabase.com/security and https://supabase.com/legal/dpa. These services may receive certain technical information and usage data. Some data may be processed on servers outside the EU/EEA, including in the USA.
7. Transfer of data outside the EU/EEA
We use cloud-based services, including in the USA, which may involve the transfer of personal data to countries outside the EU/EEA. In such cases, we ensure that appropriate security measures have been taken. We refer to the terms for https://supabase.com/security and https://supabase.com/legal/dpa where this is further announced.
8. Your rights
As a user, you have the following rights:

You can delete your user profile in the app at any time, which will also delete your personal information.
